Brian Astrup’s Expertise In my final semester of law school I have developed litigation skills as a student lawyer in the Rutgers Childrenu2019s Justice Clinic, where I represent juveniles in state court. I appear in court every other week and my responsibilities include interviewing clients, corresponding with our investigation team, reviewing court documents, developing case theory, preparing discovery requests, and negotiating plea deals with the State. I also draft motions, briefs, and other documents as needed.Research and write on the procompetitive versus anticompetitive effects of u201cproduct hoppingu201d in the pharmaceutical industry, paying particular attention to protecting consumers while not stifling innovation.While working with the National Labor Relations Board, I investigated numerous unfair labor practice charges. Prior to my investigations I performed a significant amount of legal research in order to ensure I obtained the relevant facts from the parties while I took their affidavits. I also spent a considerable amount of time corresponding with the partiesu2019 attorneys and requesting relevant documents. Thereafter, I would determine if a case had merit, and present my recommendation to the Regional Director. Some of the issues in the cases I investigated included Collyer deferral, Section 8(a)(1), (3), (4), and (5), and Section 8(b)(1)(A). This experience strengthened my communication and investigation skills. Additionally, I earned the opportunity to independently conduct over twelve representation elections.In addition to working full-time during both my 1L and 2L summers, I also invested 15-30 hours each week with Professor Edelman. I researched and wrote on topics involving antitrust, intellectual property, labor, and sports law. I often researched narrow areas of the law, for example, whether group licensing would be considered anticompetitive under the Rule of Reason, and whether a labor organization breaches its duty of fair representation by advocating for some members to the detriment of its other members. These experiences allowed me to further develop my considerable research and writing skills.I researched and wrote memorandum on social and economic policy involving employment and labor law. Additionally, I prepared a comparative study on the labor laws of several European countries and the differences to labor law in the U.S.Conducted legal research and drafted five judicial opinions on topics including: Section 1983; tortious interference with contract; which state law applies to an interstate compact; and wrongful death. This experience allowed me to sharpen the effectiveness of my research and improve the organization of my writing.u2022 Conducted legal research on workers compensation, personal injury, and contract law matters. u2022 Drafted and responded to requests for admissions, interrogatories, and production of documents. u2022 Corresponded with clients, judges, judicial clerks, opposing counsel, and witnesses. u2022 Negotiated settlements and other aspects of litigation with opposing counsel and insurance adjusters. u2022 Observed trials, hearings, depositions, arbitrations, and mediations.u2022 Used innovative techniques to help children at a local elementary school to overcome their academic deficiencies in areas such as Math, English, History, and Science. u2022 Assisted the 21st Century Program in a broad range of enrichment programs.
