Joe Kordzi’s Expertise As the Regional Haze Coordinator for EPA Region 6 I lead teams of professionals in the review of regional haze State Implementation Plans (SIPs), and in the development of regional haze Federal Implementation Plans (FIPs). These FIPs result when EPA disapproves the State's SIP as not meeting federal Clean Air Act and Regional Haze Rule requirements. FIPs are large projects that can take years to complete, require a great deal of technical and legal analysis, often require the services of outside contractors, have large budgets, and can require the installation of air pollution controls that exceed $1 billion in cost. I was the project lead on the Oklahoma Regional Haze Federal Implementation Plan, the New Mexico Regional Haze Federal Implementation Plan, and the newly finalized Texas Regional Haze Federal Implementation Plan (see attached Federal Register publications). As the project lead, I am responsible for the overall scheduling and coordination of the project. In addition, I perform most of the non-modeling technical analysis, which includes the pollution control cost evaluation. The control cost evaluation involves the analysis of the performance capabilities of various types of controls and the estimation of their costs, which can run into the hundreds of millions of dollars per control. I am the main author of the Federal Register Notice for these projects, and the non-modeling technical support documents. After the notice is proposed, I manage the team that responds to public comments, which can run into the thousands of comments. Following the publication of the final FIP decision, EPA is typically litigated by various groups, which can include the affected industry groups, environmental groups, and the state’s attorney general. I serve as the technical liaison to the Department of Justice in the defense of those law suits. I have also provided control cost evaluation for several other regional haze FIPs, both inside and outside EPA Region 6.I served as a water quality modeler in the Ecosystems Protection Branch. My duties included the review and approval of State modeling analyses, performing surface water quality modeling runs, and reviewing and commenting on contractor and State prepared TMDL reports. I also prepared TMDL reports and determined whether particular basin stream segments should be delisted from State §303 (d) lists, or have a TMDL prepared.I assisted the Deputy Regional Administrator in developing and implementing initiatives and special projects. I analyzed and coordinated various program and policy options and consequences that required responses or information flow to the Deputy Regional Administrator. I was occasionally required to develop an outreach strategy in order to address citizen's concerns. I analyzed, evaluated, and developed written recommendations from a wide array of information and divergent input from the programs pertaining to environmental program and administrative issues for the DRA. I communicated information and made recommendations to management for the effective evaluation of program options. On occasion, I was tasked with the coordination of special projects that either did not fall into a traditional program jurisdiction, or had particularly sensitive aspects. In so doing, I frequently met with managers and staff in order to resolve competing interests, make recommendations to the DRA for new R6 initiatives, and develop strategies. I also coordinated a variety of regional activities that required the DRA's participation.I served as a regional engineering expert, with the responsibility of directing, reviewing, and evaluating a wide range of complex problems relating to the deep well injection of hazardous waste. This included the review and performance of complex analytical and numerical reservoir modeling of fluid flow through porous media, and the direction and analysis of injection well falloff testing. I was a founding member of the EPA Region 6 Ground Water Center, and have served as a project manager for a number of special projects within it. I typically led the development of the strategy for accomplishing the task. I served as a technical consultant to Region 6 for the North Cavalcade Street, South Cavalcade Street, Popile, Tex Tin, and Louisiana Army Ammunition Plant Superfund sites. I served as the Region's technical lead to the Department of Justice on its civil case against Koch Industries, the second largest privately held company in the United States. This case involved the release of approximately 3 million gallons of petroleum in 310 separate pipeline breaks. These spills occurred in Texas, Kansas, Louisiana, Oklahoma, Alabama, and Missouri between 1990 to 1996. The successful settlement of this case resulted in a $35 million civil penalty, which for at least ten years remained as the largest civil fine ever imposed on a company under any federal environmental law. This case involved hundreds of separate oil pipeline spills, which contaminated waters of the U.S. My work involved the formulation of EPA's technical strategy, the mapping and technical analysis of these spills, and functioning as the Region's technical project manager for the case. I was also deposed as an expert witness for the Government.
